Terms of Service
These Terms are an agreement between you and Mana Earth Media ("we," "us"). They cover the Mischief Dating app, website and services (the "Service").
By creating an account or using Mischief Dating, you agree to these Terms, our Privacy Policy and our Community Guidelines. If you don't agree, don't use Mischief Dating.
1. Who can use Mischief Dating
- You must be at least 18 years old.
- You must be able to enter a binding contract, and not be barred from using the Service by law or by an earlier removal from Mischief Dating.
- You must not have been convicted of, or pleaded no contest to, a felony or indictable offense involving violence or sexual conduct, and you must not be required to register as a sex offender.
- You may have one account, with accurate information, including your real date of birth and photos of you.
2. Your account
You're responsible for keeping your login secure and for everything done with your account. If you think someone else has access to it, email support@mischiefdating.com right away.
Your username must be yours to use. It can't impersonate anyone or infringe anyone's rights, and we may reclaim usernames that break these Terms.
3. What Mischief Dating is
Mischief Dating is a dating app for meeting people near you. It includes your dating profile (photos, videos, prompts and a voice intro), Nearby (swipe or browse people in your area), likes and Shooting Stars, matches and chats, a dating feed, stories and Moments. We may add, change or remove features.
Matches and messages. You can message someone once you've both liked each other. We can't promise that someone you message won't copy or screenshot what you send. Share only what you're comfortable with.
Voice notes and kept messages. Voice notes disappear 24 hours after they're played, or 7 days after they're sent if nobody plays them. Once you've played a voice note you can keep it, and you can keep a text message at any time. Kept messages stay inside the app; the other person is told, and whoever sent a message can delete it for both of you at any time.
Private photos and videos. In one-to-one chats, a photo or video our check flags as nudity arrives blurred and can be opened only once. After it's viewed, it's gone for both of you. Viewing once can't stop someone from photographing their screen, so only send what you're comfortable with.
No recording by members. You may not record, capture or rebroadcast a call, voice note, video, story or chat without the consent of everyone in it. Some states, including California, require every person's consent to a recording.
Stories and posts. Stories last 24 hours unless you also add them to your Moments. Other members may see, share or react to what you post where the app allows it.
Sample profiles. While the app is new, some profiles, posts and stories are samples we made to show how it works. They aren't real members.
No background checks. We don't run criminal background checks or identity screening on members, except the optional photo verification described in the app. Please read the Dating Safety Tips before you meet anyone.
4. Your content
"Your content" is everything you post or send: profile details, photos, videos, voice, stories, messages, links and places you tag. You keep ownership of it.
You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display and adapt your content only as needed to run, protect and improve the Service and to show it where you chose to share it. We won't use your voice, image or messages in advertising without your separate permission.
This license ends when you delete the content or your account, except for content others have already saved or shared, backups kept for a limited time, and content we must keep for legal or safety reasons.
You confirm that you have the rights to what you post, including any music, photos or video in it, and that it follows these Terms and the Community Guidelines.
5. Rules of conduct
You agree to follow the Community Guidelines. In particular, you won't:
- harass, threaten, stalk, bully or intimidate anyone, or post hate speech;
- post or send anything that sexualizes minors, or intimate images of anyone without their consent;
- post or send nudity or sexually explicit content where the Community Guidelines prohibit it;
- scam, ask members for money, send spam, or use the app to sell products or services;
- impersonate anyone or lie about your age or identity;
- scrape the Service, use bots, bypass security or limits, or collect other members' information;
- record or share other members' voices, images or messages without their consent.
6. Other members and meeting in person
You are responsible for your interactions with other members, online and in person. We don't control what members do and can't confirm what they tell you. Use care and good judgment, and meet in public places. If you are in danger, call your local emergency number (911 in the US).
7. Safety, moderation and enforcement
There is no tolerance for objectionable content or abusive members. Every profile, message, post and story has Block and Report. We review reports, aim to act on them within 24 hours, and remove content and members that break the rules.
We use automated tools to help keep Mischief Dating safe, including checks for nudity in photos and videos, a profanity filter in public areas, and limits on how fast you can post. A person reviews every harassment report before a strike is given.
Strikes. Confirmed harassment or bullying is a strike. So is a report we find was knowingly false. Three active strikes end your account permanently. Strikes expire after 12 months, and you can appeal a strike once.
Immediate removal. We may end your account at once, without strikes, for: sexual content involving minors; sharing or threatening to share intimate images; credible threats; posting explicit nudity where others can see it; severe hate; scams or extortion; being under 18; or conduct we reasonably believe puts others at risk. Banned members may not make new accounts, and we may use account details to prevent it.
Appeals and removal requests. To appeal a decision, or to ask us to remove an intimate image of you shared without your consent, email support@mischiefdating.com. We remove such images within 48 hours of a valid request.
8. Third-party services
Mischief Dating works with other services, such as GIF search, place search and weather. Your use of those services is governed by their own terms, and we aren't responsible for them or for links members post.
9. Our rights and your feedback
The Service, including the Mischief Dating name, logo, artwork, design and software, belongs to us and our licensors. We give you a personal, non-transferable, revocable license to use the app as these Terms allow. If you send us ideas or feedback, we may use them without owing you anything.
10. Copyright complaints
If you believe something on Mischief Dating infringes your copyright, send a notice with your contact details, the work, where the material is, and a statement that you believe in good faith the use isn't authorized. To send one, email support@mischiefdating.com. We respond as the Digital Millennium Copyright Act requires and end the accounts of repeat infringers.
11. Ending your account
You can pause your profile at any time in Settings. You can delete your account at any time in Profile → Settings → Account & safety → Delete account. We then delete or de-identify your information as the Privacy Policy describes. We may suspend or end your access as described in Section 7. Sections 4 (as limited there), 6, 9 and 12 to 16 continue after your account ends.
12. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the Service will be uninterrupted, secure or error-free, or that you will find a match or a relationship.
13. Limits on liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages; for lost profits, data or goodwill; or for the conduct of other members, online or in person.
Our total liability for any claim is limited to the greater of US $100 or the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
You agree to indemnify us against claims arising from your content, your conduct, or your breach of these Terms or of someone else's rights.
14. Disputes
If you have a dispute with us, please contact us first so we can try to resolve it informally within 30 days. To reach us, email support@mischiefdating.com.
If that doesn't resolve it, the dispute will be decided in the state or federal courts located in California, and you and we agree to those courts, unless your local consumer law gives you the right to bring it where you live.
15. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, except where the consumer law of the place you live says otherwise.
16. Changes and general terms
We may update these Terms. For changes that matter, we'll tell you in the app or by email at least 30 days ahead where the law requires it. If you keep using Mischief Dating after a change takes effect, you accept it.
These Terms, the Privacy Policy and the Community Guidelines are the whole agreement between us. If part of them can't be enforced, the rest stays in effect. You can't transfer these Terms; we may transfer them as part of a merger or sale.
If you got the app from Apple's App Store: these Terms are between you and us, not Apple. Apple isn't responsible for the app or its content, has no duty to provide support for it, and is not responsible for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm you are not in a country under a US government embargo and are not on a US government list of prohibited parties.
